Will Contests & Will Challenges

The Orphan’s Court Division of the Court of Common Pleas hears Will contests in Pennsylvania, but not until after the Will has passed through the Register of Wills in the county where the deceased lived. This results in two different ways to attempt to contest a Will with different statutes of limitation.

When a Will is first presented for probate in Pennsylvania, it goes to the Register of Wills. If you want to contest it, you must immediately file a caveat with the Register of Wills that prevents the office from issuing a decree of probate and sends the Will to the Orphan’s Court until it has heard your objections in a formal proceeding.
